The Hendry County court is also responsible for overseeing
an estate to make sure debts are paid and proper distribution is made if assets
of a deceased person are to be properly distributed to the heirs or beneficiaries.
Wills are filed by the Circuit City Court. Disposition of Personal Property
Without Administration can be filed filed to request release of assets of the
deceased to the person who paid the final expenses; such as funeral bills or
medical bills for the last 60 days. Patrons must obtain the form from the Clerk
of the Circuit Court in the Probate Division.
The Small Claims Court Division handles all matters of resolving
civil disputes involving amounts less than $2,500.00. The Small Claim forms
are provided by the Clerk of the Court as well. If the parties are unable to
reach a settlement, the case will be set for a trial. The County Judge will
hear the case and render a written Final Judgment. An additional fee is applied
if the party awarded wants to obtain a certified copy of the Judgment re-recorded
in the Official Records.
Family Court Services assist individuals who are representing
themselves in family law matters. The program is established to provide service
throughout the Twentieth Judicial Circuit which includes: Charlotte, Collier,
Glades, Hendry and Lee Counties
